Terms & Conditions — Jiwa Explore

These terms govern bookings, tours, and travel services with Jiwa Explore.

Welcome to Jiwa Explore

These Terms & Conditions govern all bookings, tours, transportation, hotel arrangements, and travel services provided by Jiwa Adventures. By making a reservation, paying a deposit, or participating in any tour organized by Jiwa Explore, you confirm that you have read, understood, and agreed to these Terms & Conditions.

1. Booking Confirmation

A booking is considered confirmed only after:

  • The required deposit has been received.
  • The booking confirmation has been issued by Jiwa Explore.
  • The customer has provided the required personal information.

Jiwa Explore reserves the right to refuse any booking without obligation to provide a reason.

2. Payment Policy

Deposit

A deposit is required to secure every booking. Unless otherwise agreed:

  • Day Tours: 30% deposit
  • Multi-Day Tours: 30–50% deposit
  • Private Tours: As stated in the quotation

Final Payment

The remaining balance must be paid before the tour begins unless otherwise agreed in writing.

Accepted payment methods include:

  • Bank Transfer
  • Wise
  • Credit Card (if available)
  • Cash (IDR)

Any international transfer fees or bank charges are the responsibility of the customer.

3. Hotel Accommodation

If hotel accommodation is included in the booking, it is subject to availability and the hotel’s own policies and conditions. Unless otherwise stated:

  • Room type, bedding configuration, and hotel category will be arranged based on the booking details and availability.
  • Standard hotel check-in and check-out times apply unless otherwise confirmed by the hotel.
  • Early check-in, late check-out, room upgrades, and special requests may incur additional charges.
  • Hotel amenities, facilities, and services are provided by the hotel and are not guaranteed by Jiwa Explore.
  • Any damage, loss, or incident occurring at the hotel is subject to the hotel’s own rules and liability policies.

Hotel, flight, ferry, train, or third-party services may have separate cancellation policies.

4. Cancellation Policy

Cancellation charges apply as follows:

  • More than 30 days before departure: Deposit is non-refundable.
  • 15–30 days before departure: 50% of total tour price.
  • 7–14 days before departure: 75% of total tour price.
  • Less than 7 days before departure: 100% cancellation fee.
  • No-show: 100% charge.

Hotel, flight, ferry, train, or third-party services may have separate cancellation policies.

5. Changes to Booking

Changes requested by the customer are subject to availability. Additional costs may apply for:

  • Hotel changes
  • Date changes
  • Destination changes
  • Transportation changes

Jiwa Explore can not guarantee availability after confirmation.

6. Customer Cancellation Due to Personal Reasons

No refund will be provided if a guest voluntarily leaves the tour because of:

  • Illness
  • Personal reasons
  • Missing transportation
  • Visa issues
  • Failure to arrive on time

7. Health & Medical Requirements

Guests must ensure they are physically and mentally fit for the selected tour. Customers must inform Jiwa Adventures before departure of:

  • Medical conditions
  • Allergies
  • Pregnancy
  • Disabilities
  • Special dietary requirements

Jiwa Explore may refuse participation if a condition creates a safety risk.

8. Travel Insurance

Travel insurance is strongly recommended. Insurance should include:

  • Medical expenses
  • Emergency evacuation
  • Trip cancellation
  • Personal accident
  • Lost baggage
  • Personal belongings

Jiwa Explore is not responsible for uninsured losses.

9. Passport, Visa & Travel Documents

Customers are responsible for ensuring:

  • Passport validity (minimum six months)
  • Required visas
  • Immigration requirements
  • Entry regulations

Jiwa Explore accepts no responsibility for denied entry.

10. Customer Responsibilities

All guests must:

  • Follow the instructions of guides and drivers.
  • Respect local customs and traditions.
  • Respect wildlife and the environment.
  • Obey Indonesian laws.
  • Behave respectfully toward other guests.

Jiwa Explore reserves the right to remove any guest whose behavior endangers others.

11. Safety

Adventure travel involves inherent risks. These may include:

  • Weather conditions
  • Ocean currents
  • Wildlife
  • Mountain terrain
  • Boat travel
  • Road conditions

Participation is entirely at the customer's own risk.

12. Transportation

Transportation schedules may change due to:

  • Traffic
  • Weather
  • Ferry schedules
  • Government regulations
  • Natural disasters

Jiwa Explore is not liable for delays beyond our control.

13. Force Majeure

Jiwa Explore shall not be liable for cancellation, delays, or changes caused by:

  • Natural disasters
  • Volcanic eruptions
  • Earthquakes
  • Floods
  • Pandemics
  • Government restrictions
  • Civil unrest
  • War
  • Airline disruptions
  • Extreme weather

Alternative arrangements may be offered where possible.

14. Liability

Jiwa Explore acts as an agent for hotels, airlines, ferries, transport providers, and activity operators. We are not liable for:

  • Personal injury
  • Death
  • Loss of property
  • Theft
  • Delays
  • Third-party service failures

Our liability is limited to the amount paid directly to Jiwa Explore.

15. Activities

Some activities involve physical risks, including:

  • Hiking
  • Snorkeling
  • Diving
  • Rafting
  • ATV
  • Surfing
  • Waterfalls
  • Volcano trekking

Participants join these activities voluntarily.

16. Environmental Responsibility

Guests are encouraged to:

  • Avoid single-use plastics.
  • Respect wildlife.
  • Protect coral reefs.
  • Dispose of rubbish responsibly.
  • Support local communities.

17. Photography

Jiwa Explore may take photographs or videos during tours for promotional purposes. Guests who do not wish to appear should notify us before the tour begins.

18. Smoking, Alcohol & Drugs

Smoking is prohibited in vehicles unless permitted. Illegal drugs are strictly prohibited. Indonesia has extremely strict drug laws, including severe criminal penalties. Guests under the influence of drugs may be removed from the tour without refund.

19. Scooter & Driving Regulations

Guests renting or riding scooters must:

  • Hold a valid driving licence and International Driving Permit where required.
  • Wear a helmet.
  • Follow Indonesian traffic laws.

Driving under the influence of alcohol or drugs is strictly prohibited. Jiwa Explore accepts no responsibility for traffic violations or accidents.

20. Cultural Respect

Visitors are expected to respect Indonesian culture. When visiting temples:

  • Wear appropriate clothing.
  • Follow local customs.
  • Respect religious ceremonies.
  • Follow guide instructions.

Disrespectful behaviour may result in removal from the tour.

21. Lost Property

Jiwa Explore is not responsible for lost, stolen, or damaged belongings. Guests should keep valuables with them at all times.

22. Complaints

Any complaint should be reported immediately to the tour leader or Jiwa Explore so reasonable efforts can be made to resolve the issue during the trip.

23. Governing Law

These Terms & Conditions are governed by the laws of the Republic of Indonesia. Any disputes shall be subject to the jurisdiction of Indonesian courts.
